Terms of Use for AI-Powered Chatbot ("Chatbot")

This Chatbot uses artificial intelligence (“AI”) to assist you with basic tasks and answer questions related to your electricity service from Tuas Power Limited and its group of companies ("Company"). By using the Chatbot, you ("User") agree to these Terms of Use ("Terms").

1. Scope of Service and Limitations of AI Technology:

(a) The Chatbot is powered by artificial intelligence ("AI") which is designed to learn and improve over time, it may not always understand your requests perfectly.

(b) The Chatbot's responses may be influenced by the data it has been trained on, including any biases inherent in that data, and may not be specific to the Company's services. It is possible that the Chatbot may provide inaccurate or incomplete information, misunderstand your questions, or be unable to answer complex inquiries.

(c) Users acknowledge that the Chatbot is for general informational purposes only and should be used at their own discretion. Users are responsible for verifying any information obtained through the Chatbot before making any decisions.

2. Information and Disclaimers:

(a) The Company strives to ensure the accuracy of the information provided by the Chatbot. However, due to the limitations of AI technology, the information may not reflect the latest changes in rates, policies, or regulations. Users are encouraged to refer to Company's official website or contact customer service for the most current information.

(b) The Company disclaims all warranties, express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, and non-infringement, related to the information provided by the Chatbot.

3. User Conduct and Limitations:

(a) Users are responsible for maintaining the security of their devices and for any information stored on them. While the Chatbot may request information to assist Users, the Company recommend avoiding disclosure of any personal data or sensitive information through the Chatbot. For matters requiring such information, please refer to our online portal or contact our customer service representatives directly.

(b) Users are prohibited from engaging in actions that:

i. could damage or disrupt the Chatbot's functionality, such as providing false information or attempting to gain unauthorized access to Company systems;

ii. is/ may be for purposes that are unlawful, abusive, defamatory, indecent, threatening, obscene, pornographic, invasive of privacy or publicity rights or otherwise harmful to others;

iii. violate any applicable laws, rules and regulations, both local and international;

iv. infringe upon or violate our intellectual property rights or the intellectual property rights of others;

v. upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Chatbot; and/or

vi. collect or track the personal information of others.

(c) Users acknowledge that the Chatbot's learning process may be influenced by User interactions. Users are encouraged to provide accurate and constructive feedback to help improve the Chatbot's performance.

4. Limitation of Liability:

Under no circumstances shall the company be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the chatbot, even if the company has been advised of the possibility of such damages.

5. Intellectual Property:

The Chatbot and all content therein, including the underlying AI technology, are the exclusive property of the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws. Users are granted a non-exclusive, non-transferable license to access and use the Chatbot for their personal, non-commercial use only.

6. Data Retention and Privacy:

(a) The Company may retain anonymized transcripts of User interactions with the Chatbot for the purpose of improving the Chatbot's performance. No personally identifiable information (PII) will be retained. The Company is not obliged to provide copy of the transcript to the User.

(b) The Company may collect User's personal information only if User has requested that the Company’s staff contact them in relation to their enquiry.

(c) The Company respects User privacy. Please refer to Company's separate Legal Notice and Data Protection Notice to understand how the Company collect and use your data during Chatbot interactions. We will utilize anonymized data from User interactions to improve the Chatbot's performance.

7. Termination:

The Company may, in its sole discretion, terminate User's access to the Chatbot for any reason, with or without notice.

8. Governing Law and Jurisdiction:

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in the Republic of Singapore.

9. Entire Agreement:

These Terms constitute the entire agreement between the Company and User with respect to the Chatbot and supersede all prior or contemporaneous communications and proposals, whether oral or written.

10. Amendments:

The Company reserves the right to modify these Terms at any time without prior notice. Users are responsible for checking these Terms periodically for updates. Continued use of the Chatbot following the posting of any changes to the Terms constitutes User's acceptance of those changes.

11. Severability:

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck off and the remaining provisions shall remain in full force and effect.
